2 patches here:
1st is good - check opencv version < 3.0
it avoids more mysterious errors later.
2nd - I need this to rake test, though per upstream devs it shouldnt be needed.
Drop it, I'll carry myself as I need
(Ill move it to another branch and merge it for testing so you wont see it again)
