Avanos is a medical device company with manufacturing facilities in the U.S., Mexico, and Canada. Sidley represented Telix Pharmaceuticals Limited on its landmark strategic collaboration with Regeneron to co-develop and co-commercialize next-generation radiopharmaceutical therapies under a 50/50 cost and profit-sharing model, combining Telix’s radiopharmaceutical capabilities with Regeneron’s antibody and oncology experience. The agreement includes a US$40 million upfront payment to Telix for four initial programs, with potential to receive up to US$2.1 billion over the course of the agreement. Congratulations to Sidley partner Daniel Feith and team on being named a Runner-Up for “Litigator of the Week” by The American Lawyer’s Litigation Daily. The team was recognized for their challenge of the U.S. Environmental Protection Agency’s denial of small-refinery exemptions under the Clean Air Act’s Renewable Fuel Standard program. This week, a unanimous D.C. Circuit panel held that the EPA’s interpretation of its own regulation — that the refineries were required to satisfy the 75,000-barrel “small refinery” limit in 2023 as well as 2024 — was contrary to the plain language of the regulation, which indicated they need only meet the limit in 2024. The Sidley team representing Alon Refining Krotz Springs Inc. also included Peter Whitfield, Cody Akins, and Peter Bruland. Daniel Feith argued on behalf of both petitioners, Alon Refining Krotz Springs Inc. and HF Sinclair Parco Refining — the latter represented by a separate appellate team at Gibson Dunn.
